1. Agreement

By using this website or our services you agree to these terms and to our Privacy Policy. If you become a client, your signed service agreement also applies, and it controls wherever it differs from these terms. "Scale Route", "we" and "us" mean Scale Route, based in Canton, Ohio.

2. SMS terms

Program description

When you give us your mobile number and check a consent box on one of our forms, you agree to receive text messages from Scale Route. Depending on the boxes you check, these may include replies to your questions, demo and appointment reminders, account and service notices, and, only if you agreed to marketing messages, occasional offers and tips.

Consent is optional

Agreeing to receive texts is not a condition of purchasing any goods or services. You can use our website and book a demo without it.

Message frequency and cost

Message frequency varies based on your interaction with us. Message and data rates may apply, according to your mobile plan.

Opting out and getting help

Reply STOP to any message to cancel. You will receive one final message confirming that you have been unsubscribed, and no more after that. Reply HELP to any message for help, or email [email protected]. To rejoin, submit a form again with the consent box checked.

Carriers

Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and your device.

Privacy

We do not share mobile numbers or texting consent with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

3. Our services

We set up and manage booking, follow-up and marketing automation for local businesses, as described on this website and in your service agreement. Features depend on the plan you choose. Some features rely on third-party platforms, including mobile carriers, Meta and Google, and their availability and rules are outside our control.

4. Fees

• Plans are billed monthly in advance, month to month. You may cancel at any time, effective at the end of the current billing period.
• Setup fees are due at kickoff.
• Texting, calling and AI usage is billed at cost.
• Advertising spend is paid by you directly to the advertising platform and is not included in our fees.

5. Setup guarantee

Your system is built, tested and ready to take bookings within 14 days of our kickoff call. If we miss that date, we refund your setup fee in full and keep building. The clock starts once we have the access and answers from your kickoff checklist. Carrier approval for business texting is outside our control and can take longer; we file it on day one.

6. No promise of results

Results described on this website, including results from our own business, are examples and not promises. Your results depend on many things we do not control, such as your market, pricing, offer, reputation, responsiveness and advertising budget. We do not guarantee any level of leads, bookings or revenue.

7. Your responsibilities

• Give us accurate information about your business, services and prices, and tell us when they change.
• Only message people who have agreed to hear from you. You are the sender of messages sent from your account and are responsible for following the laws and carrier rules that apply, including the Telephone Consumer Protection Act. We will help you set this up correctly.
• Keep your login details secure.

8. Your data

Your customer list, conversations and advertising accounts belong to you. If you cancel, we will help you export your customer data on request within 30 days of cancellation.

9. Our content

This website, its text, design and graphics belong to Scale Route. You may not copy or reuse them without our written permission.

10. Disclaimers and limits

The website and services are provided "as is". To the fullest extent the law allows, we disclaim all implied warranties, and our total liability for any claim is limited to the fees you paid us in the three months before the claim arose. We are not liable for indirect, incidental or consequential damages, or for outages and actions of third-party platforms.

11. Governing law

These terms are governed by the laws of the State of Ohio. Any dispute will be handled in the state or federal courts located in Stark County, Ohio.

12. Changes

We may update these terms. When we do, we will change the effective date above. Continuing to use the website or services after a change means you accept the new terms.
